Terms of Service

1. Who you are contracting with

SwingFix is provided by Riyaan Rahman, of 2007 9th St, Lubbock, TX 79401, USA (“SwingFix”, “we”, “us”). “You” means the person using the app.

SwingFix is distributed through the Apple App Store. Your use of the app is also subject to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms sit alongside the Standard EULA and add to it. Where a term here conflicts with the Standard EULA, the Standard EULA governs, and the rest of these terms continue to apply.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use SwingFix on Apple-branded devices you own or control, for your own non-commercial golf practice, in line with the Apple Media Services Terms and the App Store Usage Rules.

You may not:

• copy, sell, rent, sublicense or redistribute the app;
• reverse engineer, decompile or disassemble it, except to the extent that law expressly permits despite this restriction;
• remove or obscure any proprietary notice;
• use the app or its outputs to build a competing product, or to train a machine learning model; or
• access the analysis service by any means other than the app, or attempt to circumvent free-tier limits, rate limits or entitlement checks.

3. No account, and what that means for you

SwingFix has no sign-up. The app identifies itself to our servers with an anonymous identifier generated on your device. That identifier is the only link between you and anything stored on our side.

So: if you lose the device, delete the app, or reset the identifier, we have no way to recognise you, and swings held only on that device are gone. Keeping a copy is your responsibility. Enable cloud sync if you want swings to survive a device change, and note the identifier from Settings → About → User ID if you may need to make a support or privacy request later.

You can delete everything we hold at any time. Deleting the app clears the local library; to remove anything synced to our servers, follow the deletion route in the Privacy Policy. We do not require you to keep an account you did not ask for.

4. The free tier

Without a subscription you get 3 swing analyses and 3 voice-coaching sessions per day, at no cost, for as long as SwingFix operates. Limits reset daily. We may change these allowances, and if we reduce them we will say so in the app before the change takes effect.

5. SwingFix Pro: subscription and auto-renewal

SwingFix Pro is an auto-renewing subscription sold through Apple’s in-app purchase system.

• What it unlocks: unlimited analyses, every Down-the-Line and Face-On metric, unlimited voice coaching, complete trends and long-term history, and the full coaching library.
• Free trial: 3 days. One trial per Apple Account. If you buy a subscription while a trial is running, the unused part of the trial is forfeited.
• Price and period: $120/year for a one-year subscription ($10/mo, billed annually), or $20/mo for a one-month subscription. Prices are in US dollars and may differ in your local storefront because of currency and tax; the price shown at purchase is the price you pay.
• Billing: payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial.
• Renewal: the subscription renews automatically for the same period at the same price unless auto-renew is switched off at least 24 hours before the end of the current period. Apple charges the renewal within 24 hours before the period ends.
• Cancelling: manage or cancel in Settings → your name → Subscriptions on your iPhone, or in the App Store app. You keep Pro until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
• Price changes: if we raise the price, Apple will ask for your consent before the new price is charged, in line with Apple’s rules; if you do not consent, the subscription does not renew.

Refunds are handled by Apple, not by us. We cannot issue, reverse or expedite a refund for an App Store purchase. Request one at reportaproblem.apple.com. Where you have a statutory right of withdrawal or a consumer-law refund right, that right is unaffected by anything in this section.

6. Referrals

SwingFix runs a referral programme: when someone installs the app through your invite link and meets the conditions shown in the app at the time, both of you receive a free month of Pro. Rewards have no cash value, cannot be exchanged, sold or transferred, and may be withheld or reversed where an invite is redeemed through self-referral, duplicate devices, automation or any other abuse. We may change or end the programme at any time; rewards already granted are honoured.

7. Acceptable use

You agree not to:

• record a person who has not agreed to be recorded, or record where filming is not permitted;
• upload content that is unlawful, or that infringes someone else’s rights;
• probe, scrape, overload or interfere with the analysis service or anyone else’s use of it;
• use the app in a way that breaks the law where you are; or
• use another person’s device identifier to obtain entitlements.

Filming at a course, a range or a club is subject to that venue’s rules and to local law on recording people. Checking is on you.

8. How the coaching is produced

SwingFix uses machine vision to measure a swing: a pose-estimation model running in our own analysis service locates body and club landmarks in the video you record, and those landmarks become the checkpoints and angles you see.

What the app then says about those numbers is not generated by a chat model. The coaching text is produced by a rules engine that ships inside the app, and the spoken version is read aloud by your device’s built-in Apple speech synthesizer. Nothing you say and no swing data is sent to any third-party AI or language-model service. The Privacy Policy sets out what leaves your device and what does not.

Either part can be wrong. A measurement is an estimate from video and is affected by framing, light and camera angle; a rule that fits most swings will not fit every swing, or every body. Treat the output as a starting point for your own judgement, not an instruction. Do not rely on it where being wrong would cost you money, an injury, or a competitive result, and never rely on it in place of a qualified coach or a medical professional. We do not warrant that any measurement or any suggestion is accurate, complete, or suitable for you.

9. Coaching library videos

Drills in the coaching library link to videos hosted on YouTube. We do not own or control those videos, and they may be changed or removed by whoever published them. Watching one means using YouTube, under Google’s terms and privacy policy rather than ours, and YouTube will see your IP address when a lesson card renders or a video opens. We are not responsible for YouTube’s service, its content recommendations, or anything it shows you alongside a video.

10. Coaching information, not medical advice

SwingFix measures body and club positions in video and returns coaching suggestions and drills. That is all it does. It is informational golf coaching. It is not a medical device, not physiotherapy, not a diagnosis, and not an injury-prevention service, and no measurement it produces should be read as an assessment of your health.

Golf is a physical activity and swinging a club carries a risk of injury. You are responsible for deciding what is safe for your body. Consult a doctor or a qualified physiotherapist before acting on anything in the app if you have an injury, pain, or a condition that could be affected, and stop if something hurts. Measurements are estimates produced from video and will not be perfect; a human coach’s judgement remains worth more than a number.

11. Your swings

Your swing videos are yours. We claim no ownership of them.

You grant us a limited, worldwide, royalty-free licence to process, store and transmit your recordings only so far as it takes to provide the service you asked for: analysing a swing, syncing it if you turned sync on, and showing it back to you. That licence exists for operating the app and nothing else. We do not use your recordings for marketing, and we do not use them to train general-purpose machine learning models. It ends when you delete the content, subject to short technical backup windows.

12. Our intellectual property

SwingFix, its name, its logo, the app, the analysis engine, the metric definitions and target ranges, and the coaching library are owned by us or our licensors and are protected by copyright and trade mark law. These terms grant you a licence to use the app; they transfer nothing else.

13. Availability and changes

Swing analysis is a network service. It needs a working internet connection, and an analysis takes up to about 90 seconds. We do not promise the service will be uninterrupted or error-free, and we may add, change, suspend or withdraw features. If we withdraw a feature that is material to a paid subscription, you may cancel and, where the law requires it, receive a proportionate refund through Apple.

14. Disclaimers

To the fullest extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that any measurement is accurate, that any suggested fix will improve your golf, or that using the app will lower your scores.

Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you have statutory rights that these terms do not affect.

15. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, for lost profits, or for lost or corrupted swing data, however caused and on any theory of liability.

Our total liability arising out of or relating to the app is limited to the greater of the amount you paid us for SwingFix in the twelve months before the claim arose, or twenty-five US dollars.

16. Apple

These terms are between you and us, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for SwingFix. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, failure to conform to a legal requirement, or a consumer protection claim. If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for the defence and settlement of that claim. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

17. Termination

You may stop using SwingFix at any time by deleting the app; cancel any subscription through Apple first. We may suspend or terminate your access if you materially breach these terms, in particular the acceptable-use section. Sections 8 to 16 and 19 survive termination.

18. Changes to these terms

We may update these terms as the app changes. The “last updated” date at the top shows the current version. Material changes will be notified in the app before they take effect, and continuing to use SwingFix after that means you accept them. If you do not accept them, stop using the app and cancel any subscription.

19. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, and the exclusive venue for any dispute is the state and federal courts located in Lubbock County, Texas. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions of your country of residence, or of the right to bring proceedings in your local courts, where the law of your country gives you that right.

Status of this document

These terms are a draft written to match Apple’s App Review Guidelines, the disclosures Apple requires for auto-renewable subscriptions, Schedule 2 of the Apple Developer Program License Agreement, and Apple’s Licensed Application End User License Agreement, and to describe the SwingFix app’s actual behaviour as built. They have not been reviewed by a lawyer. Have counsel review them, and fill in every TODO above, before the app is submitted for review.
